Vioxx Class Action Update
(October 16, 2007)

Since our last Vioxx Class Action update on June 8, 2007, we have continued to work with a National Team of 19 leading law firms across Canada to pursue a National Class Action against the makers of Vioxx. 

The Motion for Certification filed in Ontario by members of our National Team was scheduled to be heard on October 29, 30 and 31, 2007; however, it has now been adjourned until February 2008 in order for the parties to fully canvass all information to be disclosed by each party in advance of the hearing.

Locally, we are continuing to proceed with our "Carriage Motion". One of the pre-requisites for obtaining "Carriage" is to consolidate our lawsuit with the other member in Manitoba of the National Team. To that end, the Plaintiffs represented by Pollock & Company agreed to consolidate their Statement of Claim with the Statement of Claim filed by Wilder Wilder & Langtry. This occurred very recently.

There is one law firm that is not part of our National Team that is opposing our "Carriage Motion". That law firm brought a Motion raising several preliminary issues and Madam Justice McKelvey of the Court of Queen's Bench dismissed all of those Motions. Unfortunately, we believe that that law firm will be appealing and therefore we anticipate that this matter will next be headed to the Court of Appeal within months.
