Vioxx Class Action Update

On November 9, 2007, Merck & Co., Inc. announced that it entered into an agreement with several law firms of the Plaintiffs’ Steering Committee of the federal multi-district Vioxx litigation as well as representatives of plaintiffs’ counsel in numerous state proceedings to resolve certain claims filed against Merck in the United States. 

The agreement contains certain conditions that must be met in order for the settlement funds to be paid by Merck. The settlement is not a class-action settlement but rather each claim must be evaluated on an individual basis in order to determine if the criteria have been met.

It is important to note that this settlement applies to American residents only and has no impact on any class-action lawsuits filed in Canada or on Canadian residents. It is, however, a positive development.
