Vioxx Class Action Update-June 8, 2007

Since our last Vioxx Class Action update of February 28, 2006, we have continued to work with a national team of 19 leading law firms across Canada to pursue a national class action against the makers of Vioxx.

To that end, the Motion for Certification filed in Ontario by members of our national team is scheduled to be heard on October 29, 30, and 31, 2007. The result of that Motion will have a significant impact on this litigation across Canada.

Locally, we are continuing to proceed with our “carriage motion”. The only firm in Canada opposing this motion recently brought their own motion raising several preliminary issues. Madam Justice McKelvey of the Court of Queen’s Bench recently heard this preliminary motion and we were successful in arguing that it should be dismissed outright. It is our understanding that this matter will next be headed to the Court of Appeal within several months.
